Welcome to KsTumanova. This End-User License Agreement (“Agreement”) is a legally binding contract between you, the End User, and Sammitcrest Trading LLC, doing business as KsTumanova.

By purchasing, downloading, or using our digital brush products, you agree to be bound by:

By accessing, downloading, installing, or using any part of the Website or Services, you confirm that you have the legal authority to enter this Agreement, that you have read and understood its terms, and that you agree to be bound by it. If you are using the Website or Services on behalf of an organization, you represent that you have the authority to bind that entity to this Agreement. If you do not agree to these terms, please do not use the Website or Services.

In these End-User License Agreement, the following terms shall have the meanings assigned to them whenever they appear:

• "Company," "we," "us," or "our" refers to Sammitcrest Trading LLC, operating under the business name KsTumanova.
• "Country": The jurisdiction where the Company or Website owners are based, namely the United States of America.
• "Services" refers to all products, services, content, and features available through the Website.
• "Website" or "Site" refers to https://ks-tumanova.com and all related subdomains.
• "User," "you," or "your" refers to any individual or legal entity (including companies, organizations, or other business entities) accessing or using our Services, whether acting in a personal or professional capacity.
• "Digital Brush Products" or "Brushes" refers to all digital brush files, brush sets, texture files, and related digital assets sold through our Website.
• "License" refers to the limited right to use our Digital Brush Products as specified in this EULA.
• "Artwork" refers to any creative work, illustration, design, or other output that you create using our Brushes.
• "Computing Device" refers to any device capable of running brush-compatible software, including but not limited to iPads, tablets, computers, and other digital drawing devices.
• "Compatible Software" refers to digital art applications that support our brush file formats, which may include Procreate, Adobe Photoshop, Clip Studio Paint, and similar applications.
• "Personal Use" refers to use on devices you personally own or control.
• "Commercial Use" refers to use in creating Artwork for sale, client projects, or business purposes.

3.1 When you purchase our Digital Brush Products, we grant you a personal, non-exclusive, perpetual, non-transferable, worldwide license to use the Brushes under the terms specified in this EULA.

Permitted Uses

A. Device Usage

You may:

• Install and use the Brushes on an unlimited number of your personal Computing Devices.
• Sync the Brushes across your personal cloud storage accounts (iCloud, Dropbox, Google Drive, etc.) for your own access.
• Transfer the Brushes between your personal devices as needed.

B. Creative Work

You may:

• Create Artwork for any personal or commercial purpose using our Brushes.
• Sell, license, distribute, or display Artwork created with our Brushes without restriction.
• Use the Brushes in freelance work, client projects, or employment-related work.
• Create and sell physical products (prints, merchandise, books, etc.) featuring your Artwork.
• Create and sell digital products (NFTs, digital downloads, templates, etc.) featuring your Artwork.
• Use your Artwork in commercial productions (films, games, advertising, etc.).

C. Artwork Ownership

You retain 100% ownership and all intellectual property rights to any Artwork you create using our Brushes. We claim no rights to your creative output.

D. Attribution

You are NOT required to credit or acknowledge KsTumanova or Sammitcrest Trading LLC when using, sharing, or selling Artwork created with our Brushes.

E. Brush Customization

You may:

• Modify brush settings (size, opacity, flow, color, spacing, etc.) within your Compatible Software as the application permits.
• Save customized brush presets for your personal use.
• Adjust brush parameters to suit your creative workflow.

These customizations are for your personal use only and may not be redistributed.

3.2 Commercial Use Clarification

You MAY:

• Use Brushes to create a logo for a client and charge for your design services.
• Create and sell illustrations made with our Brushes.
• Use in freelance, agency, or in-house design work.
• Create client deliverables (the finished Artwork) using our Brushes.

This license is granted to you as an individual. If multiple people need to use the brushes (such as team members or students), each person must purchase their own license.

You MAY NOT:

• Sell or give the Brush files themselves to clients.
• Include the Brush files as part of project deliverables.
• Share the Brush files with team members or clients.

3.3 License Limitation

This License is granted to you as an individual user. Each person who wishes to use the Brushes must purchase their own License.

Multiple Users: If you are part of a team, organization, educational institution, or business where multiple people need access to the Brushes, each individual must purchase a separate License. Sharing a single License among multiple users is prohibited.

3.4 Free Products

If you receive free Digital Brush Products from us (promotional items, samples, free downloads), the same License terms apply as for purchased products.

4.1 No Redistribution or Sharing

You may not:

• Share, distribute, sell, rent, lease, lend, or sublicense the Brush files to any third party.
• Upload the Brush files to any publicly accessible location, file-sharing service, or cloud storage that others can access.
• Send or give the Brush files to friends, family, colleagues, students, team members, or clients.
• Include our Brushes in other brush packs, bundles, collections, templates, or asset libraries (whether free or paid).
• Make the Brush files available through any digital marketplace, store, or platform.
• Provide the Brush files to clients as part of project deliverables or file handoffs.

4.2 No Transfer of License

You may not:

• Transfer, assign, sell, or sublicense your rights under this EULA to any other person or entity.
• Share your account credentials to allow others to download the Brushes.
• Allow others to use your devices to access or use the Brushes (except for brief demonstrations).

4.3 No Derivative Brush Products

You may not:

• Create new brush products based on our Brushes and distribute or sell them.
• Modify our Brush files and redistribute them as your own creation.
• Extract textures, shapes, or algorithms from our Brushes to create competing products.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code or creation methods of our Brushes.

Note: Adjusting brush settings for your personal workflow is permitted. Creating derivative brush products for distribution or sale is prohibited.

4.4 No Commercial Exploitation of Brush Files

You may not:

• Sell, license, or monetize the Brush files themselves (as opposed to Artwork created with them).
• Include the Brush files as part of any product offering, template pack, or service.
• Offer the Brushes as a bonus, incentive, or add-on to any product or service you sell.
• Use the Brushes as a value-add in any commercial offering.

Clarification: You CAN sell Artwork created with the Brushes. You CANNOT sell or commercially exploit the Brush files themselves.

4.5 No AI or Machine Learning Use

You may not:

• Use the Brush files to train, develop, test, or improve artificial intelligence systems.
• Include the Brush files or brush data in any machine learning models or training datasets.
• Use the Brushes in automated content generation systems or AI art tools.
• Incorporate brush algorithms or parameters into AI-based creative tools.

Clarification: This restriction applies to the Brush files themselves. You may use AI tools separately in your creative process; you just cannot use our Brush files to train or improve those tools.

4.6 No Removal of Attribution

You may not:

• Remove, alter, or obscure any copyright notices, metadata, watermarks, or identifying information embedded in the Brush files.
• Claim authorship or ownership of our Brush designs.
• Misrepresent the origin or creator of the Brushes.

4.7 No Unlawful Use

You may not:

• Use the Brushes for any illegal purpose or in violation of any applicable laws.
• Use the Brushes to create content that infringes on third-party intellectual property rights.
• Use the Brushes to create harmful, defamatory, obscene, or otherwise unlawful content.

4.8 Consequences of Violation

Violation of any of these restrictions constitutes a material breach of this EULA and will result in:

• Immediate termination of your License.
• Requirement to delete all Brush files from your devices.
• Potential legal action and liability for damages.

5.1 Our Ownership

All Digital Brush Products, including but not limited to:

• Brush shapes, textures, patterns, and designs
• Brush algorithms, behaviors, and parameters
• Brush file formats and structures
• Product names, descriptions, and packaging
• Preview images, promotional materials, and documentation
• Any other content or materials included with the Brushes

are and remain the exclusive intellectual property of Sammitcrest Trading LLC. These are protected by United States and international copyright, trademark, and other intellectual property laws.

When you purchase our Brushes, you are purchasing a LICENSE to use them, NOT ownership of the Brush files or any intellectual property rights.

5.2 Your Ownership of Artwork

You own 100% of all Artwork you create using our Brushes.

This means you retain complete ownership and all intellectual property rights to:

• Illustrations, designs, and creative works produced with our Brushes
• Digital files and final outputs created using the Brushes
• Derivative works based on your own Artwork
• Any commercial applications of your Artwork.

You may:

• Copyright your Artwork in your own name.
• Register your Artwork with copyright offices.
• Sell, license, or distribute your Artwork in any manner you choose.
• Use your Artwork for any commercial or non-commercial purpose.
• Grant others rights to use your Artwork.

We claim no rights, ownership, or interest in your creative work. Your Artwork is entirely yours.

5.3 No Transfer of IP Rights

Nothing in this EULA transfers any intellectual property rights in our Brushes to you. You receive only the limited usage rights explicitly granted in Section 3 (License Grant).

Any use of our intellectual property beyond the scope of this License constitutes infringement and breach of this EULA.

We actively protect our intellectual property. Unauthorized use, reproduction, distribution, or creation of derivative brush products will result in:

• Immediate License termination.
• Legal action for copyright infringement.
• Claims for damages and injunctive relief.

6.1 Intended Use

Our Digital Brush Products are designed for use with digital art applications that support the file formats we provide. Common compatible applications may include Procreate, Adobe Photoshop, and similar programs.

6.2 No Compatibility Guarantee

We do not guarantee compatibility with all software versions, devices, or operating systems.

You acknowledge and agree that:

• Brush functionality may vary depending on your software and device.
• We are not responsible for compatibility issues with third-party applications.
• Software updates by third parties may affect brush performance.
• Not all features may work identically across different applications.

6.3 File Formats

Brushes are provided in the file formats specified on the product page at the time of purchase. These may include .brush, .brushset, .abr, or other formats depending on the product.

You are responsible for:

• Ensuring you have compatible software before purchasing.
• Understanding how to import and use brush files in your chosen application.
• Having the necessary technical knowledge to install and use digital brushes.

6.4 System Requirements

It is your responsibility to verify that your device and software meet the necessary requirements to use our Brushes before making a purchase.

We are not liable for:

• Purchases made without verifying compatibility.
• Performance issues related to your device or software.
• Inability to use the Brushes due to technical limitations of your setup.

6.5 Technical Support

We provide:

• Basic installation instructions for common applications.
• Email support at support@ks-tumanova.com for product-related questions.

We do NOT provide:

• Troubleshooting for third-party software issues.
• Technical support for your device or operating system.
• Custom modifications or adjustments to brush files.
• Training on how to use your digital art software.

7.1 Product Updates

We may, at our discretion, release updated or improved versions of our Digital Brush Products. This may include:

• Bug fixes or performance improvements.
• Additional brushes or expanded collections.
• New file format versions.
• Enhanced features or functionality.

If we release an updated version of a product you previously purchased, you may not automatically receive the new version for free. Updated versions may be offered as:

• Separate new products.
• Discounted upgrades for existing customers (at our discretion).
• Free updates (at our discretion).

We have no obligation to provide free updates to previously purchased products.

7.2 Download Availability

After purchasing any Digital Brush Products, you will receive access to your download files either through your account on our website (if created) or via a secure download link sent to your email.

Your Responsibilities:

• Download your purchased products promptly after purchase.
• Create and maintain backup copies of all Brush files.
• Store your purchases securely in your own storage locations.

Our Limitations:

While we make reasonable efforts to provide ongoing download access through your account, we do NOT guarantee:

• Permanent availability of downloads.
• Ability to re-download products indefinitely.
• Storage of your files on our servers forever.

We strongly recommend downloading and backing up all purchased products immediately. We are not responsible for loss of access to downloads after a reasonable period.

7.3 Product Modifications

We reserve the right to:

• Modify existing products (file formats, contents, specifications).
• Discontinue specific products or entire collections.
• Change product names, descriptions, or packaging.
• Adjust download delivery methods.

We will make reasonable efforts to notify customers of significant changes, but we have no obligation to do so.

7.4 Product Discontinuation

If we discontinue a product:

• Your License to use the downloaded version remains valid.
• We may remove the product from our store and catalog.
• Future download availability is not guaranteed.
• We are not obligated to provide substitute products.

7.5 No Liability for Changes

We are not liable for any losses, damages, or inconvenience resulting from:

• Product updates or modifications.
• Discontinuation of products.
• Loss of download access after a reasonable period.
• Changes in file formats or compatibility.
• Your failure to download or backup purchased products.

8.1 License Term

This License is perpetual, meaning it lasts indefinitely, subject to the terms of this EULA. There is no expiration date or renewal requirement for your License.

8.2 Termination by You

You may terminate this License at any time by:

• Ceasing all use of the Brushes
• Deleting all Brush files from your Computing Devices
• Removing all copies from your storage locations.

Termination does not entitle you to a refund.

8.3 Termination by Us

We may terminate your License immediately if you:

• Breach any term of this EULA.
• Violate the restrictions in Section 4.
• Use the Brushes in an unauthorized manner.
• Engage in piracy, unauthorized sharing, or redistribution.

We may also terminate your License for any other reason with or without notice, at our sole discretion.

8.4 Effect of Termination

Upon termination of your License:

• You must immediately cease all use of the Brushes
• You must delete all Brush files from all Computing Devices
• You must destroy or delete all backup copies of the Brushes
• Your right to use the Brushes ends immediately.

Termination of your License does NOT affect your ownership of Artwork created before termination. You retain all rights to Artwork you created while your License was valid.

8.5 Survival

The following sections survive termination:

• Section 5 (Intellectual Property Rights)
• Section 8.4 (Effect of Termination)
• Section 10 (Disclaimers, Liability, and Legal Terms).

If you receive free Digital Brush Products from us through promotions, giveaways, samples, or other means, all terms of this EULA apply equally to free products as to purchased products.

Free products are provided under the same License terms, with the same restrictions and permitted uses.

We reserve the right to:

• Modify or discontinue free product offerings at any time.
• Change the terms of promotional offers without notice.
• Limit the availability of free products.

10.1 Product-Specific Disclaimers

Our Digital Brush Products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We specifically disclaim any warranty that:

• The Brushes will be compatible with all software versions or devices.
• The Brushes will function identically across different applications.
• Future software updates will not affect brush performance.
• The Brushes will meet your specific creative requirements.

We disclaim any liability for:

• Loss of access to downloads after a reasonable period.
• Failure to download or backup your purchased products.
• Corruption or loss of Brush files after download.
• Your inability to retrieve files not properly backed up.

11.1 Changes to This EULA

We reserve the right to modify, amend, or update this EULA at any time, at our sole discretion. When we make material changes to this EULA, we will:

• Update the "Last Updated" date at the top of this document.
• Notify you by email if you have an account with us.
• Post a notice on our Website.

What constitutes a "material change" will be determined at our sole discretion. The version of the EULA in effect at the time of your purchase governs your License. Changes to this EULA apply to your existing License 10 days after we provide notice of the changes. Your continued use of the Brushes after the 10-day period constitutes acceptance of the revised EULA.

If you do not agree to changes in the EULA:

• You may terminate your License as described in Section 8.2.
• You must stop using the Brushes and delete all files.
• You must notify us in writing within 10 days of the change notice.
• No refund will be provided for previously purchased products.

We encourage you to review this EULA periodically to stay informed of any updates.

11.2 Relationship to Terms and Conditions

In Case of Conflict: If there is any conflict or inconsistency between this EULA and the Terms and Conditions: This EULA takes precedence for matters specifically related to Digital Brush Products, their license, and use. The Terms and Conditions take precedence for all other matters.

11.3 Entire Agreement

This EULA, together with all documents listed in Section 11.2 above, constitutes the entire agreement between you and Sammitcrest Trading LLC regarding your license to use our Digital Brush Products.

This agreement supersedes and replaces all prior or contemporaneous:

• Communications, proposals, or representations (whether written or oral)
• Agreements or understandings
• Terms, conditions, or policies regarding the subject matter of this EULA.

No Modification by Conduct: No course of dealing, course of performance, usage of trade, or oral or written representations by any party shall modify, amend, or supplement this EULA or the incorporated documents.

11.4 Acceptance

Our Terms and Conditions, Privacy Policy, Cookie Policy, and any other referenced documents are incorporated into this EULA by reference and form part of this agreement.

By purchasing, downloading, or using our Digital Brush Products, you acknowledge that:

• You have read and understood this EULA and all incorporated documents.
• You accept and agree to be legally bound by this EULA, our Terms and Conditions, Privacy Policy, and all other applicable policies.
• You meet all eligibility requirements (including age requirements).
• You have the legal authority to enter into this binding agreement.
• If purchasing on behalf of an organization, you have the authority to bind that organization to these terms.

If you do not agree to these terms, do not purchase, download, or use our Digital Brush Products.
